Patents
Patents are a group of rights granted to the owner of an invention that is "new, useful, and non-obvious".
This law firm does not prosecute new patents, but does review and draft licensing agreements for existing patents.
Trademark and Service Mark
A trademark is a distinctive indicator used to identify the unique source of goods or services. The ownership of a trademark allows the owner to bring legal precedings against the unauthorized use of a trademark. While formal trademark registration is not required for protection, rights and ability to protect the mark increase with each level of registration above mere use.
Forms of trademark include, but are not limited to devices, words, brands, signatures, names, labels, letters, numbers, shapes of goods, design, color combinations, packaging or any combination thereof.
Depending on your current and intended use of a trademark, this office can help you protect your trade or service mark locally, nationally, or internationally. Please contact the law firm for more information.
Copyright
Copyright gives rights to owners and or creators of a wide range of creative works. These works can include written works, artistic works, sound recordings, movies, software, and many other types of property. Copyright protects the work itself, not the idea behind the work.
Copyright allows the owner to produce copies of the work, perform or display the work, adapt the original work, transmit or display by radio or television, and perhaps most importantly, to sell or assign these rights to others.
Copyright is generally created automatically when the work is created. However, since many copyright disputes involve date of creation as a point of contention, formal registration is recommended to establish date of origin. Please contact the law firm for more information.
Licensing
Patents, Trademarks, and Copyrights may be licensed to other parties to use and profit from, with a royalty payment typically going to the owner of the intellectual property. Either some or all of the rights associated with the intellectual property in question may be included in the licensing agreement. For example, the licensee of a song may be allowed to perform the song, but not be allowed to sell recordings of the song.
Please contact the law firm for more information about licensing your property.
